First, Captain Salahudin Ali’s “The Bloody Nose: 10 U.S.C. § 395” argues that 10 U.S.C. § 395 will not affect the oversight requirements for certain cyber operations, particularly those that function as cyberspace operational preparation of the environment (COPEs) and occur before traditional kinetic operations. 

Second, in “Their Bottom Line: Providing A Legal Basis For Regulating Ratings Agencies To Combat Money Laundering In The Banking Industry,” Melanie Goldberg argues there remains a need to put pressure on banks to ensure they are not complicit in terrorist acts, and that the most effective alternative to lawsuits and government regulations is to ensure that ratings agencies will drop a bank’s rating for financing terrorism. Ms. Goldberg concludes that forcing ratings agencies to consider a bank’s violations when calculating their rating is the preferable option Americans should pursue if they wish to stop the financing of terror on their soil.
